Interim Exclusion Notice

If you hold a Working with Children Clearance, and you are charged with a criminal offence, you may receive an Interim Exclusion Notice from the Department of Government Services under the Worker Screening Act 2020 (Vic). Importantly, a person can receive an Interim Exclusion Notice even if they have not been found guilty of the criminal offence.

If you receive an Interim Exclusion Notice, the Department of Government Services must provide a copy of it to any organisation that engages you for child-related work.

You will, however, have the opportunity to write submissions as to why you should be given a Working with Children Clearance. These submissions must be filed with the Department of Government Services by the specified date on the Exclusion Notice.

The Exclusion Notice usually requires the submissions to include details regarding circumstances surrounding the charges and how you have been charged with the alleged offences. Character references may also be required to be included within the submissions.

Writing submissions must be done very carefully, especially if your criminal matter has not resolved. This is because you may infringe upon your right to silence. Furthermore, losing your Working with Children Clearance may affect your employment. It is therefore important you engage a legal representative who can assist you in writing submissions.
