TRAFFIC OFFENCES IN VICTORIA
There are a range of traffic / driving offences an accused can be charged with in Victoria. Traffic offences are generally found in the Road Safety Act 1986 (Vic). Some of these offences include:
- Careless driving.
- Dangerous driving.
- Dangerous driving whilst pursued by Police.
- Driving whilst suspended or disqualified.
- Drink or drug drive.
Penalties for traffic offences vary depending on the charge and the circumstances of the alleged offending. Some traffic charges may also attract a mandatory loss of licence.
However, there may be defences open to an accused. For example, if an accused is charged with driving whilst exceeding the prescribed concentration of alcohol (‘drink driving’), a defence may be that Victoria Police did not administer the test within the mandatory three hours of the accused driving a vehicle.
